The National Assembly has rejected claims that its amendments to the Elections (Amendment) (No. 2) Bill, 2024 removed the requirement for livestreaming election results.

In an official explainer dated 23 October 2026, the Assembly states that the existing requirement under Section 39(1G) of the Elections Act remains intact.

At the centre of the debate is a distinction between a proposed amendment and the existing law.

Clause 22 of the Bill received from the Senate proposed deleting Section 39 and replacing it with a recast provision. The National Assembly deleted Clause 22, thereby preserving Section 39, including the requirement for IEBC to establish a mechanism for livestreaming election results.

The Assembly says its decision was guided by a High Court judgement delivered on 22 September 2026. According to the explainer, the court upheld the constitutionality of Section 39 and Regulation 83(2), and cautioned Parliament to have regard to its interpretation when finalising electoral legislation.

The Bill also addresses voter-register inspection, political party nominations, recall of MPs, voter registration during by-elections and electoral dispute resolution.

Having passed the National Assembly with amendments on 22 October 2026, the Bill will return to the Senate under Article 110(4) of the Constitution.

The central clarification is straightforward: removing the clause that proposed replacing Section 39 preserved the existing law—and its livestreaming requirement.
